Terms of Service

This English text is a reference translation of the Japanese original, which is the authoritative version. In the event of any discrepancy between the Japanese and English versions, the Japanese version shall prevail. Please refer to the Japanese version for the binding text.

These Terms of Service (the “Terms”) set out the conditions for using the web service live.garando.dev (the “Service”) provided by its operator (“we”, “us”). By using the Service, you agree to all of these Terms.

1. Nature of the Service

The Service provides a “place” for peer-to-peer (P2P) live streaming over WebRTC, usable anonymously and without any account registration.

Video, audio, chat messages, reactions and other content are sent directly between users' devices and do not pass through or get stored on our servers.
Our server only brokers the handshake (signaling) needed to establish the WebRTC connection and counts the number of connected viewers. We do not view or record the content of communications.
The Service is intended for small, private use; large-scale broadcasting is out of scope.

2. Free of Charge; No Warranty

The Service is provided free of charge and “AS IS.” We make no warranty of any kind, express or implied, as to the completeness, accuracy, usefulness, fitness for a particular purpose, continuity, or freedom from errors or interruptions of the Service. We may change, suspend, or terminate all or part of the Service without prior notice.

3. User Responsibility and Content

You are solely responsible for any information you stream, transmit, or display through the Service (“User Content”). Because User Content is exchanged over P2P, we are technically unable to view, monitor, or store it, and we have no obligation to monitor it. Disputes between users shall be resolved between the parties at their own responsibility and expense.

4. Prohibited Conduct

When using the Service, you must not engage in any of the following:

Acts that violate laws, regulations, or public order and morals;
Infringing the copyright, trademark, likeness, privacy, reputation, or other rights or interests of any third party;
Transmitting child sexual abuse or sexual exploitation material (including child pornography) or any other illegal or harmful content;
Transmitting obscene, violent, or discriminatory content; harassment, bullying, or threats;
Impersonating others or spreading false information;
Unauthorized access to, excessive load on, or analysis or interference with the Service or its infrastructure;
Using the Service to commit or facilitate criminal acts;
Any other act we reasonably deem inappropriate.

5. Age Restriction

The Service is not intended for persons under the age of 13 (or under the higher minimum age required by the laws of your country or region, if any). Minors must use the Service only with the consent of a parent or legal guardian.

6. Note on P2P Communication

Because the Service uses P2P, by its technical nature your global IP address may be disclosed to others connected to the same room. This is an unavoidable characteristic of P2P communication and is beyond our control. You use the Service with an understanding of this.

7. Third-Party Services

The Service relies on third-party services including Cloudflare (delivery infrastructure), Google Fonts (font delivery), Google Analytics (analytics), and Google Forms (contact). Your use of these is subject to each provider's terms and privacy policy. We are not liable for damage arising from third-party services.

8. Intellectual Property

Intellectual property rights in the software, source code, design, logos, and text comprising the Service belong to us or to the rightful owners. You may not copy, modify, repurpose, or distribute them without our permission.

9. Disclaimer and Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any damage arising to you or any third party in connection with the use of or inability to use the Service, interactions between users, User Content, the use of third-party services, or otherwise in connection with the Service.

Where mandatory law (such as the Japanese Consumer Contract Act) applies and the above disclaimer is not permitted, we shall be liable only to the extent required by such mandatory law; even then, unless we acted with intent or gross negligence, our liability is limited to the ordinary and direct damages actually incurred. As the Service is provided free of charge, our aggregate liability shall in no event exceed JPY 1,000.

10. Indemnification

If you breach these Terms or cause a dispute with a third party in connection with your use of the Service, and we thereby incur damage (including reasonable attorneys' fees), you shall indemnify us for such damage.

11. Suspension or Refusal of Use

If you breach these Terms, or where we reasonably deem it necessary, we may restrict or refuse your use of the Service without prior notice.

12. Changes to These Terms

We may amend these Terms as needed. The amended Terms take effect when posted on this page. If you continue to use the Service after the amendment, you are deemed to have agreed to the amended Terms.

13. Governing Law and Jurisdiction

These Terms and your use of the Service are governed by the laws of Japan. Any dispute arising between us and you in connection with the Service shall be subject to the exclusive jurisdiction of the Tokyo District Court as the court of first instance.
